Gene Basanta speaks with WSIL about recent federal appeals court split on Affordable Care Act issue

Emeritus Southern Illinois Healthcare Professor Gene Basanta answered questions to help address some of the confusion created by the recent split in federal appeals court panel rulings on the issue of whether the government can subsidize policies purchased through federally run insurance exchanges.
On Friday, August 1, the Justice Department asked the full D.C. Circuit Court of Appeals to reverse the decision made by its three-judge panel on July 22. That panel, in a 2-1 ruling, said that the IRS can only make insurance subsidies available in states that have established their own insurance exchanges. The federal Appeals Court panel in the 4th Circuit reached the opposite conclusion in a similar case. That decision was appealed to the U.S. Supreme Court on Thursday, July 31.
